Definitions:

Client / User: anyone who places an order by registering themselves on our e-commerce portals, either in their personal capacity or on behalf of a company or legal entity, and anyone who navigates in or uses Agri Parts websites regardless of whether they place an order or not.

Dear User,

The following Cookies Policy aims to illustrate the types of cookies present in this site and their purposes, as well as to provide instructions on how a user can modify or delete them. This document is an integration to our Privacy Policy and the GDPR regulations that are listed within this document.

The policy refers exclusively to the cookies present within the Agri Parts websites: catalog.agriparts.it and agriparts.it – and not to the cookies pertaining to other sites available through links present within Agri Parts sites. This cookies policy could be periodically updated, thus we reccommend you to frequently consult this document in order to be informed on how and why cookies are used.

The versions of this policy are listed in the folowwing table, with the details of each modification.

  1. Introduction and Aims

Thereafter in this document, the term “cookies” refers to both cookies and similar technologies, for example Local Shared Objects.

The aims of this policy are to provide the neccessary information in order to manage the cookies used in this site, and to allow the user to make informed decisions.

 

  1. Policy Manager and Involved Parties

The manager of this policy, as well as the Privacy Policy, is Agri Parts S.r.l., situated in Via F. Santi 8, Villanova di Castenaso, Bologna, 40055, Italia. As previously stated, Agri Parts is the manager of the treatment of personal information conducted with the use of thier cookies, known as “first party”.

The managers of the treatment of personal information from “third party” cookies are the respective and relevant companies that are listed in the table in paragraph 4.2.

The Involved Parties, that have to visualize this policy and in some cases give consent, are the users of Agri Parts websites.

  1. References

This subject is contemplated in the GDPR (Regolamento 2016/679), in such article 30 affirms that “Physical entities/people can be associated to online markers that are created by devices, applications, tools and protocols used, such as IP addresses, temporary markers (cookies) or other types of identifiers, like radio frequency identification tags. These markers or identifiers could leave traces which, if combined with specific information received from the server, could be used to create profiles and to identify physical people.”

Despite the fact that the GDPR no longer requires consent, it is still a requirement as per the 8 May 2014 regulation for the Italian Privacy Guarantor: “Identification of simplified procedures for the information and the acquisition of consent for the use of cookies,” and it will remain a requirement until further notice. It is therefore neccessary that the user accepts and gives consent to the use of cookies and similar technologies.

 

  1. General Principles

4.1 Definition of cookies
Cookies are parcels of information (alphanumerical text files of small dimensions) sent by the site (web server) to the user’s internet browser (eg: Internet Explorer, Chrome, …) and saved on the user’s device (computer, smartphone…), and automatically resent to the site at every subsequesnt access to the site. The standard settings for most internet browsers are set to automatically accept cookies.

Different types of cookies have different classifications. Based on the usage purposes, cookies are classified in two ways:

  1. Technical Cookies: are neccessary for the correct functioning of the website and to allow the user to navigate; without such the user might not be able to correctly see the pages or some services. These cookies assure that the users’ preferences are remembered, such as language and location settings, and that the products placed in the check out cart are saved and memorised when goods are purchased online. According to laws pertaining to cookies, it is not neccessary for the user to accept these cookies.

  2.  Profilation Cookies: or “non technical”; are used to create user profiles for the purpose of sending marketing material in line with the conditions accepted by the user while using the site. The use of these cookies is prohibitied unless, prior to their implementation, the user has been informed of such and has given consent. This category includes analytics, widgets, advertising and web beacon cookies. Cookies can also be classified based on their duration (session or persistent cookies), or based on their origin (first or third party cookies). Specifically:
  • “Session Cookies”: that are deleted immediately after the internet browser is closed;
  • “Persistent Cookies”: that remain within the internet browser for a specific period of time. They are used, for example, to recognize the device with which access is being made to the site to facilitate user login;
  • “Our own” or “First Party Cookies”: generated and directly managed by the site manager for the site in which the user is navigating;
  • “Third Party Cookies”: generated and managed by different parties and not the site manager.

4.2 Cookies present within Agri Parts websites

Agri Parts websites use the following types of Technical “First Party” cookies:
a.    Navigation or Session Cookies: fundamental for the correct functioning on the site and for the user to navigate and make use of the services provided; it is not information that is stored on the users’ device and it disappears immediately after the internet browser is closed. These cookies are only valid for the navigation session.

  1. Functionality Cookies: have the purpose of improving the user experience (eg: make the navigation more efficient), by storing specific options that the user implements (eg: language). These cookies are only valid for the navigation session.

Both of these tools are used by Agri Parts to furthermore guarantee an efficient experience, a stable connection to the site and that the user is consistently logged in throughout the entire session. They are also used to save visualisation settings the user may implement for some aspects of the page (eg: informative or communicational banners or pop ups).

The usage of these technical cookies and the relevant execution of such does not require, according to the relevant disciplines, the user to give consent. However, the user will always be able to prevent the installation of such cookies at any time by changing the settings within their internet browser, yet being conscious of the fact that a decision of this type could result in complications, slowing down, and at times block the navigation on our website.

Furthermore, within the Agri Parts sites, Profilation cookies are used, such as “analytics”, to collect and analyze statistical information on the accesses made to the website (eg: nation and type of internet browser used, number of visitors). The website does not use cookies for the trasmission of personal information.

“Third Party” cookies which are stored on the users’ device, are not managed directly by the site Manager and, as their uses are external to Agri Parts websites, the third parties are solely and directly responsabile in their entirety of these types of cookies.

If the user does not want to receive third party cookies on their device, it is possible at any given moment to see the relative third party cookie policies and subsequently exclude the reception of such.

4.3 Social Buttons
Within the Agri Parts sites specific ‘buttons’ are present (named social buttons or widgets) that depict the icons or logos of social networks (eg: Facebook, etc) and of other websites. These buttons allow the user to interact directly with social networks or other sites by using a click.

In this instance, the social networking site or other sites obtain user data upon access to them, but the Manager will not share any of the users’ information or purchase details through their site with the social networking site or the other sites consultable through the use of ‘social buttons’.


4.4 How to deactivate Cookies
On occasion of the first access to Agri Parts sites, it is possible to accept all the cookies by clicking on the button “OK” or on the “X” button (to close) present on the banner or on any section of the webpage outside of the banner itself.

In every other instance and at every subsequent access made to the site, by clicking on “Cookie Policy” present in the footer at the bottom of Agri Parts webpage the user can access this policy.

 

It is furthermore possible to deactivate cookies based on the internet browser used. Although most internet browsers automatically accept cookies, the user can choose not to receive or deactivate them through the browser settings, especially in the cases where a third party involved does not provide adequate opportunities for the user to opt out. Most internet browsers also dispose of an “incognito mode” which allows the user to navigate without registering their chronology. Usually, at the end of this kind of session, all the cookies utilised are destroyed.


4.5 Conservation of Data

Information pertaining to cookies are stored for a period of time stipulated in paragraph 4.2, save for the eventualtity of an investigation due to informatical offenses.

Otherwise, the personal information liberally provided by the user though the contact forms and registration process is stored for the time period neccessary to carry out the services indicated in the relevant policies.

No personal information received through the website will be diffused or shared with unspecified parties.


4.6 Rights
As per the terms stipulated within the GDPR in relation to the treatment of personal information, the user has the right to ask the manager:

  • Access: the user can request confirmation of the handling and mangagement of their personal data, as well as extra information regarding this policy;
  • Rectification: the user can rectify or integrate the information they have provided, where it may by incorrect or incomplete;
  • Cancellation: the user may ask that their personal information is cancelled, where it is no longer neccessary for our services, in the case of withdrawal of consent or opposition to the policy, in the case of illicit treatment or if there is a legal obligation to cancel reference to subjects under the age of sixteen;
  • Limitation: the user can request that their personal information is only stored, with exception to other handling, for the period neccessary for the rectification of their details in case of unlawful processing for which they oppose the cancellation, if they have to exercise their rights in court and the data stored by the manager may be useful to them and, finally, in case of opposition to the treatment where the manager is subject to a check for the legittimacy of the treatment by the manager in relation to the users’ personal details;
  • Opposition: the user can oppose themselves at any instance to the handling of their personal information, unless there are legittimate motivations by the manager that prevail the users’, for example defense in court.
  • Transfer: the user can request to receive their data or to transmit them to an entity they authorised, in a common format readable though a device.
  • Revocation: the user can revoke their consent to our Cookies Policy at any moment, provided that it is relevant to the policy terms. The revocation of consent does not affect the legittimacy of the processing and handling of personal information conducted prior to the revocation.
